Civil Process

The Dodge County Sheriff's Office serves legal papers pursuant to Wisconsin Statute 59.27(4).

Papers for service will be accepted at the Dodge County Sheriff's Office from 8 a.m. to 4:30 p.m. Monday through Friday (except for holidays) or they may be mailed to the following address:

Only papers for service with addresses in Dodge County will be accepted.

When requesting paper service please provide the Dodge County Sheriff's Office with the paper to be served plus one additional identical copy per party being served and the completed Paper Service Information Form.

All civil process fees must be prepaid before service will be attempted.

Please bring or send the exact amount for payment. Cash or check payments must be mailed or dropped off with your papers. You may also use a debit or credit card. A nominal service fee will be added when using your debit/credit card.

If you plan to e-mail your paperwork, please only send a single PDF attachment that includes the Paper Service Information Form, papers to serve in the order you want them served, and the receipt of debit/credit card payment. Please do not e-mail one page at a time. We will NOT accept photos of the papers to be served (which are typically .png or .jpg attachments). Your attachment MUST be a PDF.

Effective June 1, 2022 all Writs of Restitutions turned over to the sheriff for service will require the Eviction Service Form and the Eviction Procedure Requirements to be completed. These forms require detailed information on your tenants for awareness and officer safety. You may want to complete these prior to arriving at the sheriff's office. These forms will need to be completed in their entirety before we will accept the writ from you.

Service Fee

$75.00 (Effective 1/1/23) — This fee covers three attempts and mileage. Additional attempts will require another $75.00 pre-payment. Those requesting a waiver of fees must provide the court fee waiver at the time the papers are presented to the sheriff's office.

Service Fee for additional defendants (same address)

$30.00 — This fee covers three attempts and mileage. Additional attempts will require another $30.00 pre-payment.

Service Fee for additional defendants (different address)

$75.00 (Effective 1/1/23) — This fee covers three attempts and mileage. Additional attempts will require another $65.00 pre-payment.

Sheriff's Sale posting Fee

$75.00 — The posting fee of $75.00 is charged each time a posting is required.

Sheriff's Sale Fee

$75.00 — The sale fee is required to be paid at the time the sale is held. Sales are held every Wednesday at 10:00 a.m. in the sheriff's office main lobby.

Writ of Replevin and Execution Against Property Fee

$100.00 — This fee covers service, mileage and one hour of deputy time at productive hourly rate of pay of deputy. Additional deputy time will be charged and billed at productive hourly rate of pay of deputy. Upon delivery of a Writ of Replevin or Execution Against Property to the sheriff and after payment to the sheriff of the fee required by statute 814.70(8), the sheriff shall execute the writ. Any Writ of Replevin or Execution Against Property needs to be accompanied with a Bond of Indemnity to sheriff in the amount of 2x the value of the property being seized. The writ will not be served if the bond is not included.

Writ of Restitution and Writ of Assistance Fee

$100.00 — This fee covers service, mileage and one hour of deputy time at productive hourly rate of pay of deputy. Additional deputy time will be charged and billed at productive hourly rate of pay of deputy. Upon delivery of a Writ of Restitution or Writ of Assistance to the sheriff and after payment to the sheriff of the fee required by statute 814.70(8), the sheriff shall execute the writ. Our office allows the defendant(s) five business days to remove themselves and property from the residence. A deputy will return to the residence on the sixth business day to confirm the defendant(s) have left the residence.

Alternative Disposition of Writ of Restitution and Writ of Assistance and Deposit

If the plaintiff or the plaintiff's attorney or agent does not notify the sheriff that the plaintiff or his or her agent will remove and store or dispose of the property, the sheriff may require that prior to execution of any Writ of Restitution or Writ of Assistance, the plaintiff deposit a reasonable sum representing the probable cost of removing the defendant's property chargeable to the plaintiff under statute 814.70(8) and (10) and of the services of deputies under statute 814.70(8). In case of dispute as to the amount of the required deposit, the amount of that deposit shall be determined by the court under statute 814.70(1).
